Allahabad High Court Dismisses Petition Against Rahul Gandhi Over Controversial Remarks

The Allahabad High Court has recently rejected a petition seeking to file a first information report (FIR) against Rahul Gandhi, the Leader of Opposition in the Lok Sabha. The case stemmed from remarks made by Gandhi regarding the influence of the Bharatiya Janata Party (BJP) and the Rashtriya Swayamsevak Sangh (RSS) on Indian institutions, which he described as a battle not only against political entities but also against the Indian state itself.

The decision was rendered by Justice Vikram D Chauhan, following a petition presented by Simran Gupta, an office-bearer of the Hindu Shakti Dal, a Hindutva organisation. Gupta’s appeal was previously dismissed by a lower court in Sambhal district, Uttar Pradesh, in November. Following that ruling, she sought the intervention of the High Court, arguing that Gandhi’s comments were not only offensive but damaging to national sentiment.

During an event inaugurating the Congress party’s new headquarters in Delhi on January 15, 2025, Gandhi expressed his concerns regarding the state of democracy in India. He claimed that the BJP and RSS had infiltrated numerous institutions across the nation, stating, “If you believe we are fighting against a political organisation called BJP and RSS, they have captured almost every institution in our country. We are now fighting not just the BJP and RSS, but the Indian state itself.” This assertion has drawn sharp reactions across the political spectrum, with supporters and critics debating the implications of his words.

Gupta’s petition argued that Gandhi’s remarks could incite unrest and were disrespectful to the sentiments of millions of Indians. However, the High Court’s dismissal of the plea underscores the judiciary’s inclination to safeguard freedom of speech, particularly in a political context.
