A Mumbai court has turned down the request for anticipatory bail from two students at the Tata Institute of Social Sciences (TISS), who are facing charges related to allegedly chanting slogans in support of jailed activists Umar Khalid and Sharjeel Imam. The students are among several individuals who participated in an event last October commemorating the death anniversary of G.N. Saibaba, a former professor at Delhi University. The prosecution claims that the pair not only shouted slogans in favor of the incarcerated Khalid and Imam but also possessed materials that the authorities allege are linked to Maoist ideologies. Interestingly, while the court granted anticipatory bail to seven other participants from the same event, it cited the specific allegations against the two TISS students as critical in its ruling.
During the court proceedings, the judge emphasized the expectation of adherence to the law, particularly from students. “Being students, it was expected from the accused persons to respect the law of land,” the judge remarked, illustrating the fine line between freedom of expression and legal boundaries in India. Khalid and Imam have been imprisoned for over five years under the Unlawful Activities Prevention Act (UAPA), accused of being involved in a conspiracy that allegedly incited the riots in Delhi in 2020.
G.N. Saibaba, the figure commemorated at the event, himself faced severe legal consequences for his activism, having been accused of links to Maoist groups. Despite being wheelchair-bound and having over 90% disability, he endured more than seven years in prison. In March 2024, he was acquitted of these charges, highlighting the often contentious nature of activism and its repercussions in India.
The case of the TISS students underscores the growing scrutiny of youth activism and the legal challenges faced by individuals advocating for various causes.
