Supreme Court Affirms States’ Authority to Withdraw FIRs Against Youth Protesters

The Supreme Court of India has recently issued a clarification regarding the ability of state governments to withdraw first information reports (FIRs) against youth demonstrators. This decision came to light on Monday in response to concerns from petitioners who feared that the court’s earlier ruling, dated July 28, which allowed ongoing investigations into these FIRs, could impede the withdrawal of cases against the protesters. The court’s latest statement reaffirms the legality of such withdrawals where applicable, paving the way for potential amnesty.

Petitioners had raised alarms that maintaining the FIRs could obstruct the resolution of cases against young activists, who have been participants in various protests. The Supreme Court has now indicated that the withdrawal of FIRs is permissible under the law, aligning with the Union government’s assurances to grant clemency to students involved in these demonstrations. In its earlier ruling on July 28, the Supreme Court mandated the release of minors who had been detained during protests and directed that no coercive action should be taken against protesting students, provided they do not possess any “criminal antecedents.” The latest clarification specifically highlighted that the term “criminal antecedents” pertains exclusively to serious and grievous offenses, which can help mitigate concerns regarding arbitrary legal actions against peaceful protesters.

The Cockroach Janta Party has welcomed the Supreme Court’s recent clarification. Party representatives expressed their anticipation that state governments, particularly those led by the Bharatiya Janata Party (BJP), will promptly adhere to the assurances made on July 25 to the youth protesters across the country. They emphasized that the youth had honored their commitments, and now it’s time for the state to reciprocate.

The court’s rulings and the government’s assurances are significant in the context of the ongoing youth-led protests in India, which have often highlighted broader issues related to governance, civil rights, and freedom of expression.
