Supreme Court Considers Fund Release for TMC Amid Ongoing ED Investigation

The Supreme Court of India has recently posed a significant question to the Enforcement Directorate (ED) regarding the possibility of releasing a limited sum of funds from the frozen bank accounts of the Trinamool Congress (TMC). This query arose during a hearing on Monday, as the court examined a plea filed by the ruling party in West Bengal, led by Chief Minister Mamata Banerjee, challenging a previous order from the Calcutta High Court.

The TMC’s legal team argued that the party requires access to its resources to cover essential daily operational expenses, despite the ongoing investigation into its financial dealings. Justices MM Sundresh and PB Varale presided over the hearing, where they sought clarity from the ED concerning the potential for a court-appointed administrator to manage limited fund releases from the TMC’s locked accounts.

The backdrop of this legal tussle is a July 20 decision by the Calcutta High Court, which denied the TMC’s request to operate three bank accounts that the ED had frozen under the Prevention of Money Laundering Act. These accounts, reportedly containing deposits of approximately Rs 440 crore, were halted following allegations of financial misconduct, including the unlawful collection of funds and the routing of suspicious transactions.

On June 19, the Kolkata Police acted on a complaint from rebel TMC MLA Biswanath Das, who alleged that party funds had been misappropriated, leading to the freezing of debit operations on the accounts. This situation has exacerbated existing factional disputes within the TMC, particularly after its electoral setbacks in the West Bengal Assembly elections held in May.

Adding another layer to the investigation, the ED revealed that around Rs 160 crore from the TMC’s accounts had been transferred to Carewell Aviation India Private Limited, raising further questions about the party’s financial integrity. As the legal battle continues, political observers will be keenly watching how this situation unfolds and what implications it may have for the TMC’s future operations and its standing in West Bengal politics.
