Calcutta High Court Upholds Freeze on TMC Bank Accounts Amid ED Investigation

The Calcutta High Court has denied the Trinamool Congress (TMC) permission to access three of its bank accounts, which have been frozen by the Enforcement Directorate (ED). In a ruling delivered on Monday by Justice Krishna Rao, the court upheld the freeze, dismissing the party’s request to lift the restrictions. The TMC is challenging the ED’s actions, which come under the Prevention of Money Laundering Act, 2002, following allegations of financial misconduct.

The case comes against the backdrop of allegations of financial irregularities involving the TMC, particularly regarding the unlawful collection of funds and the suspected routing of money through the party’s bank accounts. The Kolkata Police initially froze the accounts on June 19, prompted by a complaint from rebel TMC MLA Biswanath Das, who alleged mismanagement and misuse of party funds.

In a significant development, the ED announced on July 8 that it had officially frozen the three accounts, which contain deposits amounting to Rs 440 crore. The agency claims that approximately Rs 160 crore was transferred from the TMC’s accounts to Carewell Aviation India Private Limited and a related entity between April and June 2023. This money, according to the ED, was subsequently used to finance the acquisition of an Embraer Legacy 600 aircraft and an Agusta 109 Grand New helicopter.

The TMC has faced increasing scrutiny and challenges following its defeat in the West Bengal Assembly elections in May, which has intensified factionalism within the party. The ongoing ED investigation adds a layer of complexity to the party’s internal dynamics and could have far-reaching implications for its leadership and operational capabilities.

As the TMC continues to contest the ED’s findings and seeks to regain control over its finances, the outcome of this legal battle will be closely watched.
