The Madhya Pradesh High Court has taken significant notice of the death threats and communal harassment directed towards a Muslim judge following her ruling in a lynching case. On June 12, Additional District and Sessions Judge Tabassum Khan delivered a verdict sentencing seven individuals for the brutal killing of truck driver Sheikh Lala Nazir Ahmed in Barakhar village, Seoni Malwa tehsil. The assault took place in 2022 when a group accused Ahmed of being involved in cattle smuggling. Following the conviction, social media erupted with videos that featured explicit death threats and communal slurs aimed at Judge Khan, alongside disturbing scenes of effigies of the judge being burned during protests.
Recognizing the gravity of the situation, a division bench comprising Justices Vivek Agarwal and Avanindra Kumar Singh emphasized that such threats directly undermine the independence of the judiciary, which is a cornerstone of democratic governance. The court underscored that the threats posed not only impede the fearless functioning of judicial officers but also create an atmosphere of fear and intimidation that could hinder future judicial proceedings.
In response to the alarming threats, the High Court has mandated that Judge Khan continue to receive police protection as an interim measure while the authorities are directed to ensure her safety. Furthermore, the court instructed the Madhya Pradesh Director General of Police and the additional chief secretary for home affairs to submit personal affidavits detailing the actions taken to safeguard the judge and address the perpetrators of these threats.
This incident highlights the broader issues of communal tensions and the challenges faced by the legal system in India.
