Delhi High Court: Press Freedom Does Not Justify Irresponsible Journalism

The Delhi High Court emphasized that the freedom of the press should not serve as a justification for irresponsible journalism or actions that threaten public order. This assertion was made by Justice Girish Kathpalia while granting bail to two individuals accused of assaulting two freelance YouTubers in an incident that raised questions about the boundaries of press freedom.

The incident in question occurred on July 4, 2025, when two individuals, claiming to be journalists, were filming videos in an unauthorized area of Seemapuri, a locality in Delhi. They were reportedly attacked by local residents, who not only assaulted them but also vandalized their motorcycle and confiscated their mobile phones and personal items. Following the incident, a first information report (FIR) was filed the next day, leading to the arrest of the accused.

During the court proceedings, the prosecution argued that the assault represented an affront to press freedom. However, the court pointed out that the complainants were not affiliated with any recognized media organization; instead, they were freelancers working for a YouTube channel. Justice Kathpalia remarked that the absence of prior notification to the police by the complainants before starting their recording did not provide grounds for justifying the alleged attack.

Nevertheless, the court acknowledged the broader implications of the case, particularly the argument about whether the attack constituted an attack on journalistic freedom. The rapid expansion of social media and digital content platforms has complicated the landscape of journalism, leading to blurred lines regarding what constitutes responsible reporting.

This case highlights the ongoing challenges faced by new media practitioners in India, especially in regions where the legitimacy of freelance content creators can be in dispute. The court’s ruling serves as a reminder that while press freedoms are vital in a democratic society, they come with a responsibility to uphold ethical standards and respect local laws.
