Calcutta High Court Directs West Bengal DGP to Frame SOPs on Egg-Throwing Incidents, Handcuffing and Rope Restraint of Accused

The Calcutta High Court, while hearing a Public Interest Litigation (PIL) concerning incidents of post-election violence in West Bengal, has issued significant observations and directions to the state administration.

The PIL highlighted incidents including alleged mob violence, egg-throwing at accused persons, and instances where individuals in police custody were allegedly paraded in public while handcuffed or restrained with ropes tied around their waists.

During the hearing, the High Court observed that maintaining law and order while protecting the dignity and fundamental rights of individuals is the constitutional responsibility of the State. The Bench expressed concern over practices that could undermine human dignity and the rule of law.

The Court directed the Director General of Police (DGP), West Bengal, to formulate and issue Standard Operating Procedures (SOPs) to prevent incidents such as egg-throwing at accused persons. It also instructed the DGP to issue comprehensive guidelines governing the use of handcuffs and rope restraints while escorting accused persons, ensuring compliance with established legal and constitutional principles.

The High Court further emphasized that police authorities must strictly adhere to the safeguards laid down by the Supreme Court and ensure that such incidents do not recur.

The matter will be taken up again after the State places its compliance report before the Court.
