Supreme Court Directs CBI to Investigate Madhya Pradesh Dowry Death Case

The Central Bureau of Investigation (CBI) is set to take over the investigation into the tragic death of a woman in Madhya Pradesh, as confirmed by the Union government in a statement to the Supreme Court on Monday. The deceased, Twisha Sharma, was reportedly subjected to harassment by her in-laws over dowry demands, prompting her family to seek justice.

The Supreme Court bench, comprising Chief Justice Surya Kant, Justice Joymalya Bagchi, and Justice Vipul Pancholi, was addressing a suo motu case that highlights concerns over institutional bias and irregularities in the initial investigation. Solicitor General Tushar Mehta informed the court that the CBI is prepared to initiate its probe, ensuring that all necessary administrative procedures will be completed promptly. The court expressed its satisfaction, stating, “Fair trial has been ensured now; the CBI is probing.”

During the proceedings, the bench revealed its discomfort with the narrative suggesting that the judiciary was protecting the accused, particularly since Sharma’s husband, Samarth Singh, is a practicing lawyer, and her mother-in-law, Giribala Singh, previously served as a district judge. The court remarked, “A narrative was also created that a fair investigation was denied due to involvement of judiciary,” which ultimately led to the initiation of these proceedings.

Moreover, the justices urged the media to refrain from interviewing potential witnesses or family members, cautioning that such coverage could adversely affect the ongoing investigation. In light of the sensitive nature of the case, the court’s request serves as a reminder of the judicial system’s commitment to maintaining the integrity of the legal process.

The dowry system remains a significant social issue in India, with the law criminalizing dowry demands and related violence.
