Retired Bureaucrats Criticize CJI’s Remarks on Environmental Activism Amid Development Debate

A group of retired civil servants has raised serious concerns regarding recent remarks made by Chief Justice Surya Kant during a court hearing on environmental clearances for the Pipavav port expansion project in Gujarat. The comments came while the Supreme Court was deliberating an appeal against the National Green Tribunal’s (NGT) decision to uphold the project’s environmental approvals.

On May 11, the bench, led by Chief Justice Kant, dismissed the petition that sought to challenge the NGT’s November ruling. During the proceedings, the Chief Justice questioned the environmental litigants, stating, “Show us one project in India where environmental activists say we welcome this project, the country is progressing well, we welcome this project.” This statement implied that such petitions primarily serve to impede progress on development initiatives, according to reports from The Indian Express.

The Supreme Court did emphasize its commitment to environmental considerations, asserting that it critically assesses any project that poses risks to ecological integrity. Nevertheless, the remarks have drawn sharp criticism from the Constitutional Conduct Group, an organization comprised of former bureaucrats. In an open letter, the group expressed their dismay, suggesting that the Chief Justice’s comments reflect a dangerous bias against environmental activists, a troubling stance for someone in a position of such significant judicial authority.

In their letter, the retired officials articulated that the Chief Justice’s suggestion that environmental activists are merely obstacles to development is alarming. They emphasized that judicial figures are mandated to remain impartial and make decisions based solely on the merits of each case, devoid of any preconceived biases. The group underscored that environmental concerns are paramount and must be treated with the seriousness they deserve.
