The Madras High Court has directed its registry to officially consider a petition that calls for an inquiry into allegations of income suppression and unaccounted cash transactions linked to Vijay, the head of the Tamilaga Vettri Kazhagam (TVK). The petition, submitted by M Rajkumar in April, urges the Income Tax Department to thoroughly investigate Vijay’s financial dealings, specifically focusing on evidence gathered during previous search operations, sworn statements made by Vijay, and various assessment proceedings. It also calls for the initiation of legal actions under the Income Tax Act, particularly against those who allegedly attempt to evade taxes deliberately.
Previously, the registry had declined to list the petition, citing concerns about its maintainability. However, following a hearing, Chief Justice SA Dharmadhikari and Justice G Arul Murugan emphasized that such evaluations fall within the purview of the court rather than the registry. They clarified that if there were any doubts regarding the petition’s validity, the registry could mark it for review while including a note about its maintainability. This decision underscores the judiciary’s commitment to ensuring that all petitions receive due consideration.
The bench asserted, “It is for the court to determine the maintainability of the case, and if deemed maintainable, to then evaluate it based on its merits.” This ruling not only highlights the judicial process’s integrity but also reinforces the importance of adhering to legal norms in political matters.
