Madras High Court Overturns Government Job Offers to Families of Karur Stampede Victims

The Madurai bench of the Madras High Court delivered a significant ruling on Monday, nullifying a Tamil Nadu government order that had offered government employment on compassionate grounds to the relatives of those who lost their lives in a tragic stampede in Karur district. The incident occurred on September 27 during a political rally addressed by Tamilaga Vettri Kazhagam leader Vijay, who has since become the Chief Minister of Tamil Nadu after his party emerged as the largest in the recent assembly elections.

The court’s decision came from a division bench consisting of Justices C.V. Karthikeyan and R. Sakthivel, who determined that the government’s decision to provide jobs to the families of the deceased victims was unconstitutional. They emphasized that this action breached the principles of equality and equal opportunity as outlined in the Indian Constitution. The judges highlighted that numerous individuals are presently on waiting lists for compassionate appointments within various government departments, indicating a pressing need for fairness in allocating such opportunities.

In their judgment, the court remarked, “When there is a waiting list, it is not appropriate to overlook their needs and extend what is termed as succor to family members of the Karur incident.” This statement underscored the necessity of adhering to established protocols and ensuring that all eligible candidates receive fair consideration.

Furthermore, the bench expressed concern that granting compassionate appointments solely in the context of the stampede could set a concerning precedent, potentially leading to a flood of similar claims stemming from other tragic incidents, such as accidents or calamities. By addressing this issue, the court aims to maintain the integrity of public employment processes and uphold the principles that govern them.

The stampede itself was a devastating event that led to the deaths of 41 individuals and left many families in mourning.
