Congress Challenges Rejection of Meenakshi Natarajan’s Rajya Sabha Nomination

The Indian National Congress has formally approached the Election Commission of India, asserting that the rejection of Meenakshi Natarajan’s nomination for the Rajya Sabha elections was erroneous. The party claims that the decision made by the returning officer was influenced by objections raised by the Bharatiya Janata Party (BJP).

Natarajan, the Congress candidate slated for the Rajya Sabha elections scheduled on June 18 in Madhya Pradesh, faced a setback when her nomination was dismissed. This occurred after the BJP accused her of failing to disclose information regarding a pending criminal case against her in Telangana. The returning officer requested clarification from Natarajan, allowing her until 6 PM on Tuesday to defend her position.

Despite her explanations, the returning officer ultimately decided to reject her nomination. Natarajan contended that the legal representatives of the Congress were not adequately heard during the proceedings, raising concerns about the fairness of the process.

On Wednesday, a delegation of prominent Congress leaders, including KC Venugopal, Abhishek Manu Singhvi, Jairam Ramesh, and Randeep Surjewala, held a press conference to articulate their grievances. Singhvi emphasized that the returning officer’s decision was erroneous and did not align with the stipulated legal framework.

He cited Section 33A of the Representation of the People Act, 1951, which mandates candidates to disclose any cases against them that involve a potential punishment of two years or more, as well as those in which charges have been formally framed. Singhvi pointed out the critical distinction that the process of framing charges is inherently judicial, implying that Natarajan’s case should not have warranted a rejection based solely on allegations.

The Congress delegation seeks to have the Election Commission review the case, arguing for a fair reconsideration of Natarajan’s nomination. They assert that it is imperative for democratic processes to be upheld and that due diligence must be exercised in such matters, especially when political motivations may cloud the judicial review.

This incident underlines the ongoing tensions between the Congress and the BJP, especially in the politically charged atmosphere of Madhya Pradesh, as both parties prepare for the upcoming elections. The outcome of this appeal may not only impact Natarajan’s political future but also set a precedent for how nomination disputes are handled in the Indian electoral landscape.
