Supreme Court Overturns Fine on Art of Living, Orders Refund for Yamuna Floodplain Damage

In a significant ruling on Saturday, the Supreme Court of India annulled a 2017 order by the National Green Tribunal (NGT) that had imposed a penalty on the Art of Living Foundation for damaging the ecologically sensitive Yamuna floodplains during its World Culture Festival in March 2016. The Supreme Court directed the Delhi Development Authority (DDA) to return the Rs 5 crore fine that the Art of Living Foundation had previously paid as part of the restoration effort following the event. This landmark decision was reached by a bench comprising Justices Satish Chandra Sharma and NK Singh, who considered an appeal lodged by Vyakti Vikas Kendra India, the organization affiliated with the foundation.

The World Culture Festival, celebrated in March 2016, marked the 35th anniversary of the Art of Living Foundation. However, the event was marred by controversies as environmental groups and NGOs raised concerns about its potential impact on the Yamuna floodplains, an area noted for its ecological significance. Prior to the festival, a scientific panel from the NGT had highlighted the risks, suggesting a hefty penalty of Rs 120 crore due to the anticipated environmental damage.

Despite these concerns, the NGT ultimately permitted the event to proceed, albeit with a reduced fine of Rs 5 crore.
