Researcher Seeks Stay on Defamation Trial Against Rahul Gandhi Over Savarkar Remarks

A researcher has approached the Bombay High Court with a request to pause the ongoing defamation proceedings against Congress leader Rahul Gandhi, stemming from his comments regarding the Hindutva proponent VD Savarkar. The petitioner, Pankaj Phadnis, contends that the Pune court presiding over the matter is overstepping its authority by attempting to ascertain the bravery or cowardice of Savarkar, a contentious figure in Indian history.

Phadnis, who claims to possess in-depth knowledge of Savarkar’s life and ideologies, filed an interim application with the Bombay High Court on Wednesday. His plea follows the Special MP/MLA Court in Pune’s rejection of his previous request to intervene in the defamation case, which has garnered significant attention since its inception. Notably, the Pune court had previously imposed a fine of Rs 20,000 on Phadnis for allegedly wasting judicial time with his application.

The defamation case was initiated by Satyaki Savarkar, the grandnephew of VD Savarkar, who accused Gandhi of making disparaging and erroneous statements about Savarkar during a public event in London in March 2023. The remarks reportedly questioned Savarkar’s valor and contributions to the nation, leading to a legal backlash aimed at Gandhi.

In his application to the High Court, Phadnis criticized the Pune court for what he termed “judicial indiscipline” and for issuing “perverse orders.” He argued that the court’s inquiry into Savarkar’s character was inappropriate and that it detracted from the larger implications of free speech and political discourse. Phadnis’s petition also calls for the appointment of an amicus curiae, suggesting that an independent legal advisor should assess the evidence being presented in the ongoing proceedings.

The case has sparked debates about the limits of political discourse in India, particularly concerning figures like Savarkar, whose legacy remains divisive. As the legal battle unfolds, it raises questions about the implications for public figures when expressing opinions on historical personalities and the balance between defamation and free expression in the Indian judicial system.
