Supreme Court Suspends Madras High Court’s Decision on Jobs for Families of Karur Stampede Victims

The Supreme Court of India has intervened to stay a ruling by the Madras High Court that annulled a Tamil Nadu government order aimed at providing employment to the families of victims who lost their lives in a tragic stampede in Karur. This order came after the stampede occurred on September 27 during a rally led by Tamilaga Vettri Kazhagam chief Vijay, who was addressing his supporters from a campaign vehicle. The unfortunate incident resulted in the deaths of 41 individuals.

On Friday, a bench consisting of Justices JB Pardiwala and K Vinod Chandran issued the interim order while also instructing the state to respond to the petition filed against the High Court’s ruling. The Supreme Court’s decision to stay the earlier ruling underscores the state’s intentions to exercise its powers in granting compassionate appointments as part of its policy decision.

The legal representatives for the state argued that the government acted within its rights to offer employment to the bereaved families as a form of compensation following the tragedy. “A stampede took place. An unfortunate incident happened,” the court reflected during the proceedings. “The government has decided to compensate them. Should the government not give employment?” This statement highlights the court’s recognition of the emotional and financial toll such tragedies impose on families.

The Madurai bench of the Madras High Court had previously contended that the appointments made for the kin of the stampede victims were a breach of constitutional rights, particularly the right to equality.
