A United States federal court has officially dismissed the criminal charges against Indian billionaire Gautam Adani, a decision that has stirred considerable interest in both financial and political circles. Judge Nicholas Garaufis made the ruling on Monday, responding to a request from prosecutors who sought to abandon their case against Adani concerning allegations of securities fraud.
The judge’s dismissal came after he expressed concern over the unusual manner in which the decision to drop the charges was handled. In particular, Judge Garaufis criticized Trent McCotter, a senior official from the US Justice Department, for collaborating closely with the defense without proper consultation with the Federal Bureau of Investigation (FBI) or the Securities and Exchange Commission (SEC), both of which were integral to the investigation. In his remarks, Garaufis emphasized that such a decision-making process was “highly unusual” and raised questions about the integrity of the proceedings.
The controversy traces back to November 2024, during the latter part of President Joe Biden’s administration, when a federal grand jury in Brooklyn, New York, indicted Gautam Adani, his nephew Sagar Adani, along with six others. They were accused of conspiring to bribe Indian government officials, allegations that sparked significant media scrutiny and public discourse.
In a court filing dated July 4, McCotter articulated that the case’s foreign nature and the difficulty in proving the charges rendered it non-essential to the current priorities of the Justice Department. As a result, the legal team decided to withdraw the allegations against Adani and the other co-defendants, a move that poses questions about the case’s viability from the very beginning.
Gautam Adani, who has been a prominent figure in India’s business landscape, has faced various challenges over the past years, including issues related to corporate governance and regulatory scrutiny. The dismissal of these charges, while a relief for him, may not fully erase the concerns surrounding his business practices in the eyes of international investors and regulators.
