Supreme Court Backs Intensive Revision of Voter Rolls to Ensure Fair Elections

In a significant ruling, the Supreme Court of India has upheld the legality of the special intensive revision of electoral rolls carried out by the Election Commission. The court emphasized that this initiative plays a pivotal role in promoting the constitutional mandate for free and fair elections. The decision was announced on Wednesday, with Chief Justice Surya Kant and Justice Joymalya Bagchi presiding over the case.

The Supreme Court highlighted that the Election Commission’s authority to conduct such revisions is derived from Article 324 of the Constitution, along with the provisions of the Representation of the People Act of 1950. This Article not only establishes the Election Commission but also grants it comprehensive powers to oversee, direct, and manage the electoral process, including the preparation of electoral rolls.

However, the court also addressed concerns regarding the Election Commission’s inquiries into the citizenship status of individuals seeking to be included in the voter list. It clarified that these inquiries should not be misconstrued as a formal determination of an individual’s citizenship. The Chief Justice noted, “Such an inquiry does not amount to a determination of citizenship in the strict sense and any action taken pursuant thereto is confined to electoral consequences alone.” This distinction is crucial to understanding the limitations of the commission’s powers in this context.

Moreover, the court mandated that the Election Commission must submit a list of individuals who were removed from the electoral rolls in Bihar due to uncertainties surrounding their citizenship status to the Union government within four weeks. This directive aims to facilitate a proper assessment of these individuals’ citizenship claims, ensuring that their rights are safeguarded during the electoral process.

This ruling comes at a time when the importance of voter inclusivity and electoral integrity is being keenly debated across the nation. The Supreme Court’s decision reinforces the necessity for vigilance in maintaining the democratic process, ensuring that elections remain a true reflection of the electorate’s will while also addressing concerns about eligible voters and their status.
