Bombay High Court Permits Indian-origin Doctor to Return to UK Amid Controversy Over Social Media Posts

The Bombay High Court has intervened to allow British citizen Sangram Patil, an Indian-origin doctor, to return to the United Kingdom after a contentious legal battle sparked by his critical social media posts about Bharatiya Janata Party (BJP) leaders. The court directed the Maharashtra government to amend a lookout circular that had previously barred Patil from leaving India.

Patil, who is also known for his work as a content creator, faced scrutiny after making comments on various social media platforms that were deemed “objectionable” by some BJP leaders. His online activity led to his detention upon arrival at Mumbai’s Chhatrapati Shivaji Maharaj International Airport on January 10, when he returned to India from London. Authorities acted on a complaint filed by BJP leader Nikhil Bhamre, who accused Patil of deliberately spreading misleading and defamatory information about the party.

Following the complaint, a first information report (FIR) was lodged against Patil by the state’s cybercrime department under the Information Technology Act. This legal action led to the issuance of a lookout notice, which is typically employed by law enforcement to monitor individuals entering or exiting the country. As a result, Patil was initially detained and subsequently released with a notice to participate in the investigation.

However, the situation escalated when immigration officials prevented him from boarding his flight back to London on January 19, citing the ongoing lookout circular. This continued restriction on his travel raised concerns over the implications of such legal actions on free speech and the rights of individuals expressing dissenting opinions.

Patil’s online presence is significant; he boasts over 400,000 subscribers on his YouTube channel, along with a substantial following on Facebook. His posts, which criticize certain political figures and policies, have sparked discussions about the boundaries of expression in a politically charged environment. The Bombay High Court’s decision to allow him to return home has been viewed by many as a necessary step towards upholding individual liberties against potential political overreach.
