Kerala High Court Upholds Hormone Therapy for Transgender Individuals Amid Legal Controversies

The Kerala High Court has recently ruled in favor of two transgender individuals, allowing them to continue their hormone replacement therapy. This decision comes in the wake of claims that medical facilities had suspended their treatments following the enactment of the 2026 Transgender Persons Protection of Rights Amendment Bill.

This controversial legislation, which was passed by the Parliament on March 25 after a motion to refer it to a parliamentary committee was rejected, modifies the existing 2019 Transgender Persons Protection of Rights Act. The amendment notably redefines the criteria for who can be classified as a transgender person, effectively removing the right to self-identification and restricting the law’s applicability to individuals with specific biological traits, intersex variations, or traditional socio-cultural identities such as kinner, hijra, aravani, and jogta.

Justice Bechu Kurian Thomas presided over the High Court proceedings on Friday, where he heard arguments related to two petitions challenging the amended Act. Following deliberations, he issued a notice regarding the petitions, reflecting the ongoing legal discourse surrounding the amendment. The petitioners contended that the new provisions contradict the landmark ruling from the Supreme Court in the 2014 National Legal Services Authority (NALSA) v. Union of India case, which recognized the right to self-identification for transgender individuals and established them as a socially and economically disadvantaged group.

The petitioners also highlighted that the amendment’s requirement for compulsory medical certification undermines the principles laid out by the Supreme Court, which had paved the way for the recognition of a third gender category. This recognition was intended to empower transgender individuals within Indian society, providing them with essential rights and protections.

As India grapples with the complexities of gender identity and rights, the Kerala High Court’s decision serves as a critical juncture in the ongoing struggle for recognition and equality among transgender communities.
