Chhattisgarh High Court Rules Out Kidnapping Charges in Minor Elopement Case

The Chhattisgarh High Court recently delivered a significant ruling asserting that individuals cannot be charged with kidnapping if a minor elopes voluntarily. This clarification came as the court acquitted a 24-year-old man, who had previously been sentenced to 20 years in prison under the Protection of Children from Sexual Offences (POCSO) Act.

The case dates back to September 2022 when a 15-year-old girl left her home without informing her family. Following her disappearance, her father lodged a complaint with the police, leading to an investigation that discovered she had eloped with the accused. The couple traveled across several states, including Raipur, Hyderabad, and Vijayawada, before eventually settling in Agrapalli, where they spent nearly a month together.

During the court proceedings, the bench comprising Chief Justice Ramesh Sinha and Justice Ravindra Kumar Agrawal emphasized that there was no evidence suggesting that the man had coerced or manipulated the minor into leaving her home. They noted that the victim had willingly accompanied the accused and had not expressed any resistance or complaint throughout their time together.

The trial court had initially convicted the man in October 2023, imposing a two-decade prison sentence which he subsequently appealed. The High Court’s ruling not only highlighted the lack of coercion but also raised pertinent questions about the legal interpretations of consent and voluntary actions in cases involving minors.
