Supreme Court Denies Bail to Asaram in 2013 Minor Rape Conviction

The Supreme Court of India on Tuesday rejected the bail application of Asumal Harpalani, commonly known as Asaram Bapu, concerning a 2013 case involving the sexual assault of a minor. This ruling comes as the court seeks a formal response from the Rajasthan state government within a three-week timeframe regarding Asaram’s appeal that contests the Rajasthan High Court’s earlier judgment affirming his conviction.

In April 2018, a sessions court in Jodhpur had sentenced Asaram to life imprisonment after finding him guilty of raping a minor at his ashram. His conviction was based on multiple charges, including those under the Indian Penal Code (IPC), the Protection of Children from Sexual Offences (POCSO) Act, and the Juvenile Justice Act. This landmark case highlighted the serious nature of sexual offenses against minors and underscored the judiciary’s commitment to addressing such heinous crimes.

Following his conviction, Asaram attempted to challenge the ruling in the Rajasthan High Court. In May, the court acquitted him of charges related to gang rape and sexual assault but upheld the conviction for the rape of the minor, which carries a life sentence. The High Court’s verdict confirmed that the prosecution had satisfactorily established the charges of rape under the IPC, alongside those under the POCSO Act and the Juvenile Justice Act. Asaram’s legal team subsequently escalated the matter to the Supreme Court.

On Tuesday, a bench comprising Justices MM Sundresh and Sheel Nagu acknowledged the petition but indicated that they would consider the possibility of interim bail only if there were compelling medical grounds presented in support of Asaram’s case. This stipulation reflects the court’s cautious approach in dealing with cases of sexual violence, particularly those involving minors.

The ongoing legal battle has garnered significant media attention and public interest, reflecting broader societal concerns surrounding child safety and the accountability of influential figures. Asaram, who has a considerable following, has maintained his innocence throughout the proceedings.
