Delhi High Court Revokes Stay on FIR Against Abhijit Iyer-Mitra Over Offensive Remarks Against Journalists

The Delhi High Court took a significant step on Wednesday by overturning a lower court’s decision that had temporarily halted the filing of a First Information Report (FIR) against commentator Abhijit Iyer-Mitra. The FIR was prompted by allegations that Iyer-Mitra made sexually derogatory comments about female journalists associated with the news platform Newslaundry.

Justice Girish Kathpalia, overseeing the case, expressed concern about the lack of reasoning behind the sessions court’s order to stay the FIR. He emphasized the need for a more detailed explanation, indicating that such a stay without justification was inadequate. “I want to understand what went in his [the sessions judge’s] mind to stay the order. I will send it back to pass a reasoned order,” remarked Justice Kathpalia, underlining the importance of transparency in judicial decisions.

The High Court has instructed both the journalists from Newslaundry and Iyer-Mitra to appear before the sessions court on May 22. Furthermore, it directed the lower court to resolve the matter within a four-week timeframe. This ruling illustrates the High Court’s commitment to ensuring that cases related to sexual harassment are handled with the seriousness they deserve.

Newslaundry’s Managing Editor, Manisha Pande, along with her colleagues, had previously approached a magistrate court, citing repeated instances where Iyer-Mitra employed vulgar language and slurs aimed at them. On April 23, the magistrate court recognized the potential for charges against Iyer-Mitra under various sections of the Bharatiya Nyaya Sanhita that pertain to sexual harassment and the degradation of women’s dignity.

This case has drawn considerable attention in the media landscape, not only because of the serious nature of the allegations but also due to the significant implications it holds for the discourse surrounding women’s safety and harassment in the workplace. As discussions about misogyny and gender-based harassment continue to gain momentum in Indian society, the judiciary’s approach to such cases will be closely watched, with many hoping for a precedent that upholds the dignity and rights of women.
