Delhi High Court Overturns Centre’s Rejection of Siddharth Varadarajan’s OCI Card Application

The Delhi High Court has recently overturned a decision by the Union government that denied Siddharth Varadarajan, the founding editor of The Wire, an Overseas Citizen of India (OCI) card. Varadarajan, who holds U.S. citizenship, previously possessed a Person of Indian Origin (PIO) card. Following the rejection of his application, Varadarajan approached the Delhi High Court for redress. During the hearing, Justice Purushaindra Kumar Kaurav criticized the Union government’s communication dated April 2, which failed to provide any reasons for the denial of the OCI card. The judge emphasized that substantiated reasoning is essential in such orders, stating, “Reasons are the heart and soul of the order.” This statement underscores the judicial expectation for transparency and fairness in administrative decisions.

The Union government’s counsel responded by indicating that they would seek further instructions from the relevant authorities regarding the case. However, Justice Kaurav maintained that without adequate justification, the government’s stance could not be upheld.
