The Supreme Court of India has issued a significant directive concerning the electoral process in West Bengal, mandating the Election Commission to incorporate voters whose appeals against removal from the electoral rolls have been accepted by appellate tribunals. This ruling, made public on Thursday, aims to ensure that eligible voters can participate in the upcoming Assembly elections.
The bench, comprising Chief Justice Surya Kant and Justice Joymalya Bagchi, clarified that any individual whose appeal has been resolved by the tribunals before April 21 will be permitted to vote in the first phase of elections scheduled for April 23. Furthermore, those whose appeals are approved by April 27 will be added to the final electoral rolls for the second phase of polling, set for April 29. The counting of votes for both phases will take place on May 4.
This order, initially passed on Monday, underscores the importance of ensuring that the voting rights of individuals are respected and upheld. However, it was also emphasized that merely filing an appeal against exclusion does not automatically grant an individual the right to vote. The court’s decision came in response to a petition urging that individuals with pending appeals be allowed to participate in the electoral process.
The Election Commission had previously frozen the electoral rolls for the first phase of voting, which raised concerns about the disenfranchisement of many voters whose appeals were still under consideration. The Supreme Court’s recent ruling aims to address these concerns and ensure transparency and fairness in the electoral process.
As West Bengal prepares for its Assembly elections, this ruling highlights the judiciary’s role in safeguarding democratic processes and ensuring that every eligible citizen has the opportunity to make their voice heard during the elections.
