Delhi High Court Urges CJP Leaders to Remove Defamatory Posts on BJP’s Gaurav Bhatia

The Delhi High Court made a noteworthy observation on Thursday, highlighting the responsibility of political leaders in ensuring the accuracy of their social media posts. The court’s remarks were directed towards leaders of the Cockroach Janta Party (CJP), Saurav Das and Ashutosh Ranka, who had made allegations regarding Bharatiya Janata Party (BJP) leader Gaurav Bhatia on the social media platform X.

This legal discourse emerged during the proceedings of a defamation case filed by Bhatia against Das, Ranka, and CJP founder Abhijeet Dipke. The controversy began after Das and Ranka shared an AI-generated image on September 5, which they claimed falsely represented Bhatia’s statements. The post came to light following the arrest of Swatantra Bhardwaj, a Hindutva activist implicated in an incident involving violence against the father of a student activist who participated in protests at Jantar Mantar.

Bhatia alleged that the image inaccurately attributed derogatory remarks to him, including terms like “dimaagi naxali” and “jaatiwaadi,” suggesting that he had labeled Bhardwaj in a negative light. During the hearing, the court pointed out that there are more constructive methods for expressing dissent and emphasized the importance of verifying information before sharing it online. The judges reminded the young leaders of CJP that while their enthusiasm is commendable, it is crucial to refrain from making baseless accusations.

In a practical suggestion, the court advised Das and Ranka to voluntarily retract their posts to avoid further legal complications. It was indicated that if they chose to delete the content themselves, the court would refrain from issuing a formal takedown order. Das’s legal representative informed the court that the contentious post had already been removed, illustrating a willingness to comply with the court’s recommendations.

The incident serves as a reminder of the significant role social media plays in today’s political landscape, and the responsibilities that come with it.
