The Bombay High Court has decided not to dismiss a criminal defamation case against Congress leader Rahul Gandhi, stemming from his contentious remarks where he labeled Prime Minister Narendra Modi as “choron ke sardar,” which translates to “leader of thieves.” This ruling was issued on Tuesday and is significant amid the current political landscape in India.

The case originates from comments made by Gandhi during a campaign rally in Rajasthan back in September 2018, as part of his efforts leading into the 2019 Lok Sabha elections. At that time, Gandhi was critiquing the controversial Rafale fighter jet deal, a significant point of contention in Indian politics, and directly associated Modi with alleged wrongdoing in the transaction. His slogan, “chowkidar chor hai,” or “the watchman is a thief,” became a rallying cry for the Congress party, suggesting that the Prime Minister had acted as a facilitator for industrialist Anil Ambani in this deal.

The complaint was lodged by a member of the ruling Bharatiya Janata Party (BJP), who argued that Gandhi’s remarks tarnished the reputation of not only Modi but also the BJP as a whole. The complainant contended that by referring to Modi in such derogatory terms, Gandhi effectively branded BJP members as thieves, thereby justifying the initiation of defamation proceedings against him.

In response to the case, Gandhi challenged its validity in the High Court, asserting that his comments did not specifically name any political party or its affiliates. However, Justice Nitin Borkar rejected this argument, allowing the proceedings to continue.
