Bombay High Court Criticizes FDA for Rigid License Suspension of Mumbai Cricket Association Eateries

The Bombay High Court has expressed its dissatisfaction with the Maharashtra Food and Drug Administration (FDA) for its rigid approach in retaining the suspension of licenses for five eateries associated with the Mumbai Cricket Association (MCA). This rebuke came during a hearing on Saturday, where the court highlighted the FDA’s failure to adhere to its previous directive to re-evaluate the situation.

The licenses of the restaurants, which include Permit Room, Oriental Swing, Clubway & Pastry Counter, Mediterranean, and Pavilion, were suspended recently as part of a larger initiative by the FDA targeting establishments across Maharashtra for purported breaches of food safety regulations. The eateries are located at the Sharad Pawar Indoor Cricket Academy and Recreational Centre in the bustling Bandra-Kurla Complex of Mumbai.

During the proceedings, a division bench comprising Acting Chief Justice Ravindra Ghuge and Justice Gautam Ankhad scrutinized the FDA’s actions. They were particularly critical of an assistant commissioner who had maintained the suspension without a thorough assessment. The bench remarked that the official’s decision appeared to be made without due consideration and seemed overly mechanical, lacking the necessary scrutiny that such matters deserve.

The court’s earlier order had mandated the FDA to conduct a fresh inspection of the premises to ensure a fair evaluation of the eateries’ compliance with food safety norms before making any further decisions. It was this directive that the court found was not honored, prompting a stern warning regarding potential contempt proceedings against the FDA officials involved.

This case underscores the ongoing challenges in regulating food safety standards in a vibrant culinary landscape like Mumbai’s.
