Government Seeks Supreme Court’s Intervention to Dismiss FIRs Against Youth Protesters

The Indian government has approached the Supreme Court with a plea to annul all first information reports (FIRs) related to the youth protests that erupted in Delhi in July. This move comes as the administration aims to resolve the legal controversies surrounding the protests, which were characterized by allegations of rioting, attempted murder, robbery, and destruction of public property.

The application presented by the Union government calls for the quashing of 13 FIRs, leveraging the Supreme Court’s authority under Article 142 of the Constitution. This article allows the court to issue orders deemed necessary for administering ‘complete justice’ in cases before it. This has raised questions about the implications of such a legal move, especially in a politically sensitive environment.

Solicitor General Tushar Mehta emphasized the urgency of the matter, requesting the Chief Justice Surya Kant to list the case for immediate hearing. In a significant assurance to the court, the government pledged that no new FIRs would be initiated regarding the protests mentioned in their application. Furthermore, they asserted that if any additional FIRs arise in the future, they would not oppose the quashing of those as well.

This legal development comes on the heels of a planned peaceful march by the Cockroach Janta Party, aimed at protesting perceived mismanagement in the administration of various competitive examinations. The protests have ignited considerable public discourse regarding the adequacy of governmental procedures in addressing youth concerns, especially in a country where millions aspire for jobs through such competitive exams.
