Supreme Court Seeks Input from 20 Rebel TMC MPs on Disqualification Delay

The Supreme Court of India has requested responses from 20 rebel Members of Parliament (MPs) of the Trinamool Congress (TMC) concerning a petition filed by party leader Abhishek Banerjee. This petition challenges the Lok Sabha Speaker’s delay in addressing disqualification requests against these legislators. The case was brought before a bench headed by Chief Justice Surya Kant, along with Justices Joymalya Bagchi and V Mohana.

In June, a significant political shift occurred when TMC MP Kakoli Ghosh Dastidar announced that 20 out of the party’s 28 Lok Sabha MPs would join forces with the Tripura-based Nationalist Citizens Party of India. This merger was seen as a move to ally with the ruling Bharatiya Janata Party (BJP)-led National Democratic Alliance (NDA) in the Lower House of Parliament, further complicating the dynamics within the TMC, especially following its recent electoral losses in West Bengal.

Responding to this defiance, Abhishek Banerjee filed petitions on June 19 with Lok Sabha Speaker Om Birla, seeking the disqualification of the 20 MPs on the grounds that they had abandoned the party. He cited the provisions of the 10th Schedule of the Indian Constitution, which stipulates that any member who resigns from their party is subject to disqualification. Banerjee emphasized that the legal framework is clear regarding the consequences of voluntary departure from party membership.
