Lok Sabha Approves Bill for National Tribunals Commission to Enhance Judicial Oversight

In a significant legislative development, the Lok Sabha has approved a bill aimed at establishing a National Tribunals Commission, which will oversee the appointment of chairpersons and members across 16 tribunals in India. This reform, encapsulated in the Tribunals Reforms Bill, 2026, seeks to improve the efficiency and transparency of tribunal operations in the country.

The newly proposed body will not only be responsible for the appointment process but will also evaluate the performance of tribunal members and address any complaints that arise against them. This initiative aligns with the Supreme Court’s directive from November 2022, which highlighted that certain aspects of the previous Tribunals Reforms Act, 2021, were inconsistent with the principles of judicial independence and separation of powers.

Union Law and Justice Minister Arjun Ram Meghwal presented the bill in the Lower House, emphasizing its necessity in ensuring that appointments to these key judicial bodies are conducted with fairness and transparency. He noted that the Union government will consult with the Chief Justice of India to appoint the commission’s chairperson and members. This collaborative approach is expected to foster a more robust judicial framework.

Included among the various tribunals that will fall under the Commission’s jurisdiction are the Central Administrative Tribunal, the National Green Tribunal, the Armed Forces Tribunal, the Securities Appellate Tribunal, as well as the Income-tax Appellate Tribunal, among others. This comprehensive coverage aims to streamline the processes involved in these institutions and uphold the rule of law more effectively.

The passage of this bill marks a pivotal moment in India’s judicial reform journey. By repealing the Tribunals Reforms Act of 2021, it seeks to address the shortcomings that were previously highlighted by the Supreme Court. The establishment of the National Tribunals Commission is anticipated to enhance the independence of tribunals and restore public confidence in the judiciary.
