Delhi Court Revokes Non-Bailable Warrant Against Student Leader Aishe Ghosh

A Delhi court has decided to cancel the non-bailable warrant issued against Aishe Ghosh, a prominent student leader and joint secretary of the Students’ Federation of India (SFI). This decision came after Ghosh personally appeared in court on Thursday, resolving a legal matter stemming from a 2021 protest incident outside Bangla Bhavan.

The Patiala House Court, presided over by Judicial Magistrate First Class Vijayshree Rathore, lifted the warrant that was previously enforced due to Ghosh’s absence at an earlier hearing. The court had stayed the warrant the day before after Ghosh’s lawyer explained that her non-attendance was due to unavoidable circumstances.

In addition to revoking the warrant, the court imposed a fine of ₹1,000 on Ghosh. The case relates to a first information report (FIR) filed at the Barakhamba Road Police Station in 2021 concerning a protest that took place outside Bangla Bhavan, which houses the West Bengal government’s office in Delhi. Ghosh has been charged under various sections of the Indian Penal Code, including disobedience to a public servant’s order and criminal trespass, with a chargesheet already submitted to the court.

The court has scheduled further proceedings in the matter for November 21, intensifying the scrutiny surrounding the case. This development comes in the wake of allegations made by the Communist Party of India (Marxist), which claimed that the Delhi Police made an attempt to arrest Ghosh at the party’s headquarters in New Delhi a day prior. According to the party, officers arrived in a private vehicle, raising concerns about the police’s approach and intentions.

The situation has drawn significant attention, as Ghosh’s role as a student leader places her at the forefront of various student rights and political activism issues in India. Her previous involvement in protests, particularly related to educational reforms and social justice, has made her a notable figure among youth in the country. The legal challenges she faces raise questions not only about personal freedoms but also about the broader implications for student activism in India.
