A Varanasi court has overturned a previous decision that dismissed an application for a first information report (FIR) against Congress leader Rahul Gandhi. This ruling comes in response to allegations that Gandhi referred to the revered Hindu deity Ram as a ‘mythological figure,’ which has sparked significant backlash among certain sections of the Hindu community.
The additional district and sessions judge heard the revision petition challenging the magistrate’s May 27 order that deemed the plea for an FIR as non-maintainable. The judge ordered that the case be reconsidered in light of recent rulings from the Supreme Court and the High Court, indicating a potential shift in how such comments are addressed legally.
The original complaint was lodged by an advocate who claimed that Gandhi’s statements were not only ‘hateful’ but also disparaging towards the beliefs of those who follow Sanatana Dharma, a term often used interchangeably with Hinduism. The complainant argued that these comments were particularly egregious in light of the Supreme Court’s recent judgment regarding the Ram temple, which has been a focal point of religious and political tension since the Babri Masjid demolition in 1992.
In his complaint, the advocate accused Gandhi of making repeated ‘absurd’ remarks about significant figures in Hinduism, asserting that such statements insult followers of the faith. He emphasized that the comments amounted to hate speech, constituting a serious criminal offense. Given the sensitive nature of religious sentiments in India, such remarks can lead to considerable communal discord.
This ruling not only reignites the debate surrounding freedom of speech and religious sentiment in India but also highlights the delicate balance politicians must maintain while addressing cultural and religious topics. As the case progresses, it will be closely monitored by both supporters and opponents of Gandhi and may have wider implications for political discourse in the country.
