The Calcutta High Court has intervened to prevent any coercive action against Trinamool Congress (TMC) MP Abhishek Banerjee, following his controversial statements regarding Union Home Minister Amit Shah during political rallies in West Bengal’s Assembly election campaign. The court issued its directive on Thursday, advising the West Bengal Police to refrain from any arrest or custodial interrogation of Banerjee until July 31.
Justice Saugata Bhattacharya, presiding over the case, affirmed that Banerjee’s rights were safeguarded under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita. This legal provision states that an individual cannot be detained in custody if their presence can be ensured through a notice for investigation. The judge emphasized the importance of allowing Banerjee to respond to any notices issued by the police, mandating that they should provide him with at least 48 hours to comply.
Banerjee’s statements, made during a rally, included a rhetorical question about which “godfather” from Delhi would aid them post-election, a remark interpreted as directed towards Shah and the Bharatiya Janata Party. The judge expressed concern over these comments, questioning how a sitting MP could publicly make such statements. “Such remarks were uncalled for,” Justice Bhattacharya noted, reflecting the court’s position on maintaining decorum in political discourse.
In defense of Banerjee, his attorney Kalyan Bandopadhyay pointed out the need for the court to carefully consider the implications of political speech in a democratic setup. The ongoing legal proceedings highlight the tense political climate in West Bengal, particularly as the state gears up for its Assembly elections, where political rhetoric often escalates.
