Bombay High Court Slams UIDAI for Causing Hardships Over Aadhaar Technical Issues

The Bombay High Court has expressed strong disapproval of the Unique Identification Authority of India (UIDAI), highlighting the “unnecessary hardships” that technical glitches in Aadhaar records have caused to citizens. The court’s remarks centered on how such irregularities have led to citizens being denied access to essential services and have sparked avoidable legal disputes.

The UIDAI, established under the Aadhaar Act of 2016, is responsible for assigning 12-digit unique identification numbers to all residents in India. In a ruling delivered on May 6, a bench comprising Justices Ravindra V Ghuge and Hiten S Venegavkar laid down clear directives aimed at ensuring that individuals do not suffer undue challenges stemming from biometric errors or other technical inaccuracies related to their Aadhaar records.

The judges underscored the importance of protecting residents from being left without remedies, especially when their biometric data is compromised without any allegations of fraud or impersonation. This ruling emerged from a petition filed by twin brothers, Rohit and Rahul Nikalje, who detailed their own struggles with Aadhaar updates after first receiving their cards as minors in 2012.
