Surendra Gadling Receives Bail in Bhima Koregaon Case After Prolonged Detention

The Bombay High Court has granted bail to lawyer Surendra Gadling in connection with the Bhima Koregaon case, marking a significant development after more than eight years of his incarceration. The ruling was delivered on Monday by a bench consisting of Justices AS Gadkari and Kamal Khata, who highlighted that the extended period as an undertrial prisoner warranted relief.

Gadling’s case is associated with the violent clashes that erupted near Pune on January 1, 2018, shortly after the Elgar Parishad event was held to commemorate the 200th anniversary of the Bhima Koregaon battle. The violence resulted in one fatality and numerous injuries, raising grave concerns about caste-related conflicts in the region.

According to the National Investigation Agency (NIA), the Elgar Parishad was allegedly part of a coordinated Maoist strategy aimed at inciting caste violence, undermining the Union government, and even plotting to assassinate Prime Minister Narendra Modi. A total of sixteen individuals were arrested in connection with this case, which has drawn significant public attention and scrutiny over the years.

Despite the severity of the allegations, the trial has yet to commence, even after five years since the incidents occurred. Gadling, who was among the last of the sixteen accused to remain in custody, faced opposition from the NIA during the bail hearing. The agency pointed to other legal troubles he has encountered, including a 2016 arson incident involving claims that he engaged in a criminal conspiracy that led to the destruction of over 80 vehicles.

This latest development in the Bhima Koregaon case raises questions about the prolonged detentions of those accused and the overall judicial process in high-profile cases involving sensitive social issues. As the legal battles continue, the implications of Gadling’s release may reverberate through public discourse on caste dynamics and civil liberties in India.
