Supreme Court Grants Anticipatory Bail to Congress Leader Pawan Khera Amid Defamation Case

In a significant legal development, the Supreme Court of India has granted anticipatory bail to Congress leader Pawan Khera in a case filed by the Assam Police, stemming from allegations made by Riniki Bhuyan Sarma, the wife of Assam Chief Minister Himanta Biswa Sarma. The case against Khera, which includes charges of defamation, forgery, and criminal conspiracy, originated from comments he made on April 5. Khera asserted that he possessed documentary evidence suggesting that Riniki Bhuyan Sarma holds passports from multiple countries, including the United Arab Emirates, Egypt, and Antigua and Barbuda. The chief minister and his wife have categorically denied these allegations, claiming that Khera’s statements are unfounded and based on forged documents.

Initially, Khera sought protection from arrest through the Telangana High Court, which granted him transit anticipatory bail for a week on April 10. This provision allowed him temporary relief, enabling him to approach the jurisdictional courts in Assam where the case was filed. However, just days later, on April 15, the Supreme Court stayed the Telangana High Court’s order and instructed Khera to turn to the Gauhati High Court for his plea.

After the Gauhati High Court rejected his request for anticipatory bail on April 24, Khera escalated the matter to the Supreme Court. During the hearing, Justices JK Maheshwari and AS Chandurkar deliberated on Khera’s petition, which ultimately led to the provision of anticipatory bail. This latest Supreme Court ruling allows Khera to avoid immediate arrest while the legal proceedings continue.

The case has highlighted the fraught intersection of politics and law in India, where allegations of defamation can have serious implications for political figures.
