Supreme Court Halts Life Sentence of Amit Jogi in 2003 Murder Case Involving NCP Leader

The Supreme Court of India has granted a significant reprieve to Amit Jogi, son of former Chhattisgarh Chief Minister Ajit Jogi, by staying his conviction and life sentence linked to the 2003 murder of Nationalist Congress Party (NCP) treasurer Ramvatar Jaggi. This development was reported on Thursday, marking a pivotal moment in a long-standing legal battle that has drawn considerable public and media attention.

Amit Jogi was previously convicted by the Chhattisgarh High Court on April 2, 2023, for his alleged role in the conspiracy to murder Jaggi, who was shot dead in Raipur during a politically charged atmosphere ahead of a major NCP rally. This incident occurred at a time when Ajit Jogi’s Congress-led government was under pressure from the NCP’s rising political influence in the state.

On April 6, the High Court sentenced Jogi to life imprisonment. However, the Supreme Court’s bench, consisting of Justices Vikram Nath, Sandeep Mehta, and Vijay Bishnoi, expressed skepticism about the fairness of the prior judgment. They questioned the legality of passing a conviction without affording Jogi a chance to defend himself, highlighting concerns over judicial due process. “What kind of judgment…conviction and sentence before hearing?” was the crucial inquiry raised by the bench, emphasizing the importance of a fair trial.

The Supreme Court’s latest ruling also involved issuing notices regarding Amit Jogi’s application challenging his conviction, further complicating the legal landscape surrounding the case. In the past, a trial court had convicted 28 individuals for Jaggi’s murder, but Amit Jogi was acquitted at that time. Subsequently, the Central Bureau of Investigation (CBI) contested this acquittal in 2011, seeking to reinstate charges against Jogi. However, the High Court dismissed the CBI’s application, citing delays. The government’s attempts to appeal this decision were also rejected, leading to the CBI appealing to the Supreme Court for intervention.
