Allahabad High Court Upholds Religious Freedom in Case of Voluntary Conversion to Islam

The Allahabad High Court delivered a pivotal ruling on Wednesday affirming the right of a 31-year-old man, Ayush Malik, to choose his own religious beliefs. The court found that Malik’s conversion from Hinduism to Islam was a voluntary act, free from coercion or undue influence from his family.

Justice Sandeep Jain, presiding over the case, emphasized the importance of individual autonomy in matters of faith and personal relationships. He noted that Malik’s decision to embrace Islam and subsequently marry a Muslim woman was a legitimate exercise of his personal freedoms and that there was no legal basis for his family’s attempt to restrict him.

The backdrop of this case involved Malik’s father filing an FIR under the Uttar Pradesh Prohibition of Unlawful Conversion of Religion Act after Malik’s conversion and marriage, which were against the family’s wishes. The court’s ruling came in response to a habeas corpus petition lodged by Malik’s friend, seeking the court’s intervention to verify Malik’s detention by his family.

In his judgment, Justice Jain stated, “An adult’s choice of whom to marry and the religion they wish to follow is a matter of individual autonomy.” He condemned any form of restraint placed upon Malik by his family, asserting that he should be permitted to live wherever he chooses, with whomever he pleases, as an essential aspect of his freedom.

This ruling reinforces the ongoing discourse around religious freedom and individual rights in India, particularly in the context of interfaith marriages. It highlights the courts’ role in protecting the rights of individuals against familial and societal pressures, underscoring that personal choices regarding faith should not be subject to interference.
