Delhi Court Halts FIR Against Abhijit Iyer-Mitra Over Controversial Remarks About Newslaundry Journalists

A Delhi court has put a stop to a magistrate’s decision that mandated the filing of a First Information Report (FIR) against commentator Abhijit Iyer-Mitra. This decision comes in light of his controversial social media posts, which included sexually abusive comments directed at the female staff of the news platform Newslaundry.

Additional Sessions Judge Purshotam Pathak, presiding over the case at the Saket court, highlighted that the language employed by Iyer-Mitra resembled shayari, a form of poetic expression, and did not explicitly identify any individual. The judge stated, “A thorough analysis of the language used can only take place after both parties present their arguments in detail regarding the revision petition.” This ruling signifies a fresh evaluation of the case, following a previous order by the Delhi High Court that had annulled the earlier stay issued by the sessions court.

In May, the Delhi High Court criticized the sessions court for staying the FIR without providing a clear justification. The High Court emphasized that such a decision lacked sufficient reasoning and thus directed the lower court to revisit the matter and deliver a comprehensive ruling. Furthermore, the High Court summoned Iyer-Mitra and the journalists from Newslaundry to appear before the sessions court by May 22. It also mandated that the sessions court resolve the case within a four-week timeframe.

This legal dispute underscores the ongoing tensions surrounding freedom of speech and responsibility in the digital age, particularly regarding social media platforms where public figures often express themselves without restraint.
