The Supreme Court of India has affirmed the legality of the special intensive revision of electoral rolls recently undertaken by the Election Commission. The apex court stated that this exercise is in line with the constitutional mandate of ensuring free and fair elections. The bench highlighted that the Election Commission is empowered constitutionally to carry out such revisions but clarified that its inquiries regarding voter registration do not extend to determining an individual’s citizenship status.
In a directive aimed at clarifying electoral integrity, the court ordered the Election Commission to submit the names of individuals whose entries were removed from Bihar’s electoral rolls due to concerns over their citizenship to the Union government within a week. This measure is intended to ensure that these individuals’ citizenship status can be assessed appropriately, thereby reinforcing the integrity of the electoral process.
In a significant legislative move, the Assam Assembly has also passed a bill introducing the Uniform Civil Code (UCC), which seeks to prohibit polygamy and mandate the registration of live-in relationships. The bill received opposition from various political factions, who called for it to undergo further examination by a select committee. Nonetheless, the assembly’s approval marks a crucial step in advancing legal uniformity across the state.
With this action, Assam is poised to become the third Indian state to implement a UCC, following Uttarakhand and Gujarat, since the country gained independence. Chief Minister Himanta Sarma has stated that the code will not apply to the state’s tribal population, ensuring that traditional customs and practices are respected. The introduction of the UCC is expected to spark considerable debate regarding personal laws and their implications for cultural identities in Assam.
