Supreme Court Dismisses FIRs Against Comedian Samay Raina and Others Over Disability Jokes

The Supreme Court of India has dismissed criminal charges against comedian Samay Raina and four other associates concerning remarks deemed insensitive towards individuals with disabilities during a comedy show titled “India’s Got Latent.” This ruling was delivered by a panel comprising Chief Justice Surya Kant, and Justices Joymalya Bagchi and V Mohana, who acknowledged the efforts made by Raina and his colleagues to promote awareness and support for the disabled community.

The comedians involved in this case include Vipul Goyal, Sonali Thakkar, Nishant Jagdish Tanwar, and Balraj Paramjeet Singh Ghai, the owner of The Habitat, a popular comedy venue. The Supreme Court noted that these individuals had adhered to previous directives to organize awareness programs and raise funds for people with disabilities, which played a crucial role in the court’s decision to quash the FIRs.

According to reports, the court commended the defendants for their proactive engagement in initiatives tailored for persons with disabilities. The bench remarked, “Once there are genuine efforts, positive results are bound to be there,” highlighting the potential impact of such initiatives on society. They praised the group as “bright youngsters” contributing positively to the community, anticipating beneficial outcomes from their endeavors.

As part of their commitments, the comedians hosted a chess tournament specifically for individuals with disabilities from March 14 to 16, showcasing their dedication to the cause. Additionally, they proposed to conduct four more fundraising events aimed at generating financial support for the disabled community. The court acknowledged the logistical challenges in inviting persons with disabilities to these events but recognized the respondents’ willingness to ensure inclusivity for individuals with spinal muscular atrophy and to offer financial assistance.
