The Supreme Court of India has recently decided to maintain a petition contesting the election victory of Bhupesh Baghel, the former Chief Minister of Chhattisgarh. This ruling means that the matter will now be examined by the Chhattisgarh High Court, where Bhupesh Baghel will have the opportunity to present his objections against the claims made by his rival.
Baghel, who represents the Patan constituency in the Chhattisgarh Assembly, faced a legal challenge from Vijay Baghel of the Bharatiya Janata Party (BJP). Vijay Baghel has alleged that Bhupesh Baghel violated Section 126 of the Representation of the People Act, 1951, by conducting a roadshow just a day before the elections held on November 17, 2023. This section prohibits campaigning within 48 hours prior to polling, a rule that is designed to ensure a fair electoral process.
During the court proceedings, advocate Kapil Sibal, representing Bhupesh Baghel, argued that the allegations cannot be classified as a corrupt practice under the law. He emphasized that there was no substantial evidence to support the claim that the roadshow had any impact on the electoral results. Sibal mentioned that Bhupesh Baghel won the election by a significant margin of nearly 20,000 votes, while Vijay Baghel’s assertion that only about 200 people attended the roadshow seemed unconvincing.
The Supreme Court bench, which included Chief Justice Surya Kant and Justices Joymalya Bagchi and V Mohana, noted that the legitimacy of the roadshow and its influence on the election results would need to be thoroughly examined during the trial at the High Court. This ruling underscores the judiciary’s role in upholding electoral integrity and addressing grievances raised by candidates.
