NIA Seeks to Revoke Bail of Activists in Bhima Koregaon Case Over Alleged Violations

The National Investigation Agency (NIA) has initiated an application in a special court aimed at revoking the bail previously granted to activists Arun Ferreira and Vernon Gonsalves, who are implicated in the Bhima Koregaon case. This legal maneuver comes after the agency accused the activists of breaching their bail conditions by participating in an event at the Mumbai Press Club earlier this year.

Ferreira and Gonsalves were arrested in August 2018, spending nearly five years in judicial custody before their release on bail in July 2023, a decision made by the Supreme Court under specific conditions to ensure compliance with ongoing investigations. The NIA claims that the gathering at the Mumbai Press Club was not merely a social event but rather a platform intended to promote the ideology of the banned Communist Party of India (Maoist) and strategize about the future of the so-called ‘Urban Naxal movement’.

This recent move is not an isolated incident. Earlier in May, the NIA had also filed a plea for the cancellation of bail for other activists Varavara Rao and Sudha Bharadwaj. The agency pointed to the same event at the Mumbai Press Club, arguing that their bail conditions explicitly prohibited any communication with other co-accused individuals. This pattern suggests the NIA’s increasing scrutiny over gatherings and communications among activists associated with the Bhima Koregaon case.

On Wednesday, Special Judge Chakor S Baviskar ordered Ferreira and Gonsalves to respond to the NIA’s allegations, setting the stage for the next hearing scheduled for June 19. The case has been a flashpoint for discussions surrounding civil liberties and the treatment of dissenting voices in India, with many viewing these actions as an extension of the state’s efforts to suppress political activism under the guise of national security.

The Bhima Koregaon case itself has drawn significant attention both nationally and internationally, raising questions about the balance between state security and individual freedoms.
