A Delhi court has granted bail to Swatantra Bharadwaj, a prominent Hindutva influencer, who is accused of assaulting the father of a student activist during protests that took place in July. This decision was made by the court on Tuesday, marking a significant turn in a case that has drawn considerable public attention and commentary.
Bharadwaj had initially been detained on September 4, following the emergence of a controversial video where he claimed that a call from Delhi minister Kapil Mishra helped him evade arrest in connection with the assault. In the video, he boasted about the incident, allegedly stating that he had “cracked the skull” of Sanjay Kumar, the father of Nishu Aazad, a student activist involved in the protests against alleged malpractice in competitive examinations.
On September 15, Bharadwaj was granted interim bail for a period of three weeks. During the proceedings, the court highlighted discrepancies in the investigation conducted by the Delhi Police and requested a status report from the investigating officer. The incident occurred on July 23 at Jantar Mantar, where demonstrators gathered to voice their concerns over what they regarded as serious irregularities in competitive exams.
The protests have been fueled by allegations of systemic flaws in the examination process, prompting the Cockroach Janta Party political group to organize demonstrations outside the Parliament Street police station on September 4. They called for the charges against Bharadwaj to be escalated to attempt to murder, pushing for a more serious legal response to the allegations.
In light of the growing public outcry, the Delhi Police subsequently invoked provisions from the Scheduled Castes and Scheduled Tribes Prevention of Atrocities Act and charges of criminal intimidation against Bharadwaj. The case has sparked a wider debate concerning political influence, the handling of protests, and the rights of individuals participating in demonstrations in India. While Bharadwaj claims innocence, the legal proceedings will continue to unfold, as both sides prepare for a potentially significant courtroom battle.
