Calcutta High Court Halts Arrest Warrant Against TMC MP Mahua Moitra

The Calcutta High Court has intervened in the legal proceedings against Mahua Moitra, the Trinamool Congress (TMC) Member of Parliament, by staying an arrest warrant that was previously issued against her. This decision came on a Monday, as the bench comprising Justices Debangsu Basak and Aryak Dutt ruled that no coercive measures should be taken against Moitra, who had failed to appear before a Krishnanagar court in relation to a case concerning alleged provocative remarks she made earlier this year.

The controversy revolves around comments made by Moitra on social media in June, which a Bharatiya Janata Party (BJP) leader claimed were inflammatory. The remarks followed an incident where women BJP supporters gathered outside the Krishnanagar court, allegedly intending to throw eggs and tomatoes at Moitra upon her arrival for a separate case. In response, Moitra stated on her social media platforms her intention to file a police complaint against the protesters. In a subsequent video, she controversially suggested that those wishing to conceal their identity while throwing eggs at her should wear a burqa.

The complaint filed against Moitra accuses her of making statements that could potentially incite religious sentiments and disrupt communal harmony. This situation escalated to the point where a third judicial magistrate in Krishnanagar ordered the issuance of an arrest warrant for Moitra on August 19, citing her repeated failure to comply with court summonses. The magistrate expressed concern over what was described as a “series of disobediences” to legal directives, indicating a disregard for the court’s authority.

Following the high court’s decision to stay the arrest warrant, the case has been scheduled for further hearing on August 27.
