Allahabad High Court Critiques Uttar Pradesh’s Misuse of Goonda Act

The Allahabad High Court on Thursday expressed serious concerns over the Uttar Pradesh government’s application of the Goonda Act, which is intended to manage habitual offenders. The bench, led by Justice Subhash Vidyarthi, explicitly stated that the Act is being misused as a “tool of oppression” against individuals, despite previous warnings from the judiciary regarding its potential for abuse.

This statement came during the hearing of a petition filed by Zahid Ali, who contested a directive from the Gonda district magistrate that labeled him a “goonda” under the 1970 Uttar Pradesh Control of Goondas Act. The order mandated that Ali vacate the district for a period of six months. In a significant ruling, the court overturned this order, underscoring the importance of safeguarding citizens against wrongful classification.

The court articulated that while the Goonda Act is a necessary mechanism for managing public disorder and habitual criminal behavior, it must be exercised judiciously. “The Goonda Act is a powerful tool for the control and suppression of the ‘Goondas’,” the court noted, emphasizing that it should only be invoked in unequivocal cases of public disruption. The judiciary underscored that the essence of the law is to deter recurring criminal conduct rather than to penalize individuals without a conclusive legal conviction.

In its ruling, the court highlighted that Ali had been acquitted in one of the two criminal cases cited by the authorities in their decision to label him a goonda. This case serves as a troubling example of how the law can be misapplied, leading to undue hardship for innocent individuals. The bench stressed the importance of ensuring that the Act is not wielded as a means of unjustly penalizing law-abiding citizens.
