The Supreme Court of India has chosen not to entertain a petition filed by Congress leader Meenakshi Natarajan, who sought to contest the rejection of her nomination for the upcoming Rajya Sabha elections in Madhya Pradesh. The bench, consisting of Justices Prashant Kumar Mishra and AS Chandurkar, cited Article 329 of the Constitution, which prohibits judicial interference in electoral matters.
In a significant ruling, the court explained that any disputes concerning elections to either House of Parliament, including those for the Rajya Sabha, may only be addressed through an election petition, a process distinct from ordinary legal challenges. The judges, however, did not completely dismiss Natarajan’s concerns; they permitted her the option to file an election petition instead.
During the proceedings, Natarajan argued that the Supreme Court could invoke its writ jurisdiction under Article 32 to address what she termed as “glaring and manifest” errors that led to her nomination’s rejection. Yet, the bench refuted this claim, clarifying that exercising such jurisdiction would misinterpret the stipulations of Article 329.
Article 32 of the Constitution guarantees the right of citizens to approach the Supreme Court directly for the protection of their fundamental rights. However, the court’s position indicates a strong adherence to constitutional provisions that prioritize the electoral process over individual grievances, especially in matters that may influence parliamentary representation.
Natarajan was the sole candidate put forth by the Congress party for the Rajya Sabha elections scheduled on June 18. Her nomination was rejected earlier in the week, following claims by the Bharatiya Janata Party that she had failed to disclose pertinent information required for her candidacy. This incident has sparked discussions regarding the transparency and fairness of the electoral nomination process.
