Bombay High Court Penalizes L&T Subsidiaries and Adani-Linked Firm ₹2 Lakh Over Slum Project Dispute

The Bombay High Court on Monday dismissed multiple petitions filed by construction firms, including subsidiaries of Larsen and Toubro (L&T) and a company linked to the Adani Group, concerning a slum redevelopment project in Mumbai. Justice Gauri Godse, presiding over the case, stated that the petitions had unnecessarily prolonged court proceedings and imposed a fine of ₹2 lakh on each of the involved parties.

The petitioners included L&T Asian Realty Project LLP, L&T Realty Limited, Shiv Infra Vision Private Limited, the chief executive officer of the Slum Rehabilitation Authority, and Portsmouth Buildcon Private Limited, the last being affiliated with the Adani Group. These firms sought to dismiss a commercial suit initiated by KS Chamankar Enterprises and its partner, alleging serious misconduct including fraud and conspiracy in the management of the redevelopment initiative.

KS Chamankar Enterprises had been appointed as the developer for three housing societies under the Slum Rehabilitation Authority. The firm reported that it had successfully constructed a composite rehabilitation building but was abruptly dismissed and replaced without any prior notice, leading to its legal challenge in the High Court. Chamankar alleged that there was collusion between L&T’s subsidiaries and Portsmouth Buildcon, which enabled them to usurp control of the project.

This ruling highlights the ongoing tensions in the slum redevelopment sector in Mumbai, where various stakeholders often find themselves entangled in legal disputes. It also raises questions about the integrity of the slum rehabilitation process, which is intended to provide housing for the underprivileged. The court’s decision to impose costs indicates its frustration with what it perceives as frivolous litigation that hinders progress on critical urban development initiatives.
